1. Eligibility & Account Rules

To create an account and use LaZone, you must comply with the following rules:

• Minimum Age: You must be at least 16 years of age. If you are under 16, you may not use the Platform or register an account.
• Account Accuracy: You agree to provide accurate, current, and complete information during the registration process and to keep your account credentials updated.
• Account Security: You are solely responsible for safeguarding your password and managing access to your device. You must notify us immediately at info@lazoneclimbing.com if you suspect any unauthorized use of your account.
• Single Account: Users are prohibited from creating multiple accounts or impersonating other individuals or climbers.

2. Inherent Risk of Climbing: Physical Activity & Liability Disclaimer

By using this App, you explicitly acknowledge and agree to the following:

1. Inherent Danger: Climbing, bouldering, mountaineering, and related activities (whether indoor or outdoor) are high-risk sports that carry an inherent risk of severe physical injury, permanent disability, paralysis, or death.
2. No Professional Advice: LaZone is an interactive social logging and tracking platform. The routes, boulder configurations, grades, ratings, safety information, and suggestions displayed on the App are User-Generated Content (UGC). They are compiled for informational and entertainment purposes only.
3. Not a Safety Guide: We do not verify, guarantee, or audit the physical safety, difficulty grading, structural integrity, or bolt/hold safety of any climbing route, boulder, or facility logged in the App.
4. Your Responsibility: You are solely responsible for your own safety, gear inspection, proper instruction, physical conditioning, and decision-making when attempting any climb. Always adhere to the safety rules and supervision of the climbing gym or local authorities.

ASSUMPTION OF RISK: To the maximum extent permitted by applicable law, you voluntarily assume all risks of injury, loss, or damage arising from your participation in climbing activities logged, shared, or viewed on this Platform.

3. User-Generated Content (UGC) & License

LaZone allows you to upload, post, and share content, including climbing routes, boulder configurations, photos (such as route drafts or profile avatars), comments, difficulty ratings, and text posts ("User-Generated Content" or "UGC").

A. Your Ownership

You retain all of your ownership rights in your UGC.

B. License Granted to Us

By posting UGC on the Platform, you grant us a worldwide, non-exclusive, royalty-free, perpetual, transferable, sub-licensable license to use, host, store, reproduce, modify, adapt, publish, translate, distribute, and display such content. This license allows us to display your climbed routes, photos, and ratings to other users of the climbing community on our web and mobile apps.

C. Public Visibility & Anonymization

You acknowledge that your routes, logs, ratings, and comments are public and may remain visible to other users even if you delete your profile. Upon account deletion, any logged routes or comments you contributed will be fully anonymized and attributed to an anonymous "Deleted User" to maintain database and community continuity.

4. Acceptable Use Policy & Content Moderation

To maintain a safe and welcoming climbing community, you agree not to post, upload, or transmit any UGC that:

• Is defamatory, abusive, harassing, threatening, hateful, or discriminatory.
• Is obscene, pornographic, or contains nudity.
• Infringes upon the intellectual property, copyright, or privacy rights of any third party.
• Promotes illegal activities, unsafe climbing practices, or violates the rules of the respective climbing facility.
• Contains unauthorized advertising, spam, or malicious software.

Moderation and Removal Rights (App Store Requirements)

In compliance with Apple App Store and Google Play Store policies, we enforce a strict zero- tolerance policy for objectionable content or abusive users. We reserve the absolute right, but do not have the obligation, to:

1. Monitor, screen, edit, or delete any UGC at our sole discretion, without prior notice, if we believe it violates these Terms.
2. Immediately suspend or terminate the accounts of users who repeatedly violate these acceptable use rules or act abusively toward other community members.
3. Provide integrated reporting tools within the App to allow users to flag objectionable content and report abusive behavior directly.

5. Intellectual Property Rights

Unless otherwise indicated, the Service, including its source code, databases, software, website designs, audio, video, text, photographs, graphics, logos, and trademarks (collectively, the "Proprietary Property") are owned or licensed by us, and are protected by copyright, trademark, and other intellectual property laws of Germany, the European Union, and international treaties.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service strictly for your personal, non-commercial entertainment and logging purposes.

6. Disclaimers & Limitation of Liability

A. "As Is" Disclaimer

The Platform is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties of any kind, express or implied, regarding the accuracy, availability, completeness, security, or reliability of the App or the data stored on it.

B. Limitation of Liability

To the maximum extent permitted by applicable German and European law, Tommaso Mangiagalli and Gabriele Bellan shall not be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profits, lost data, or personal injury/death arising from your use of the App, or your reliance on any routing/safety information provided within the Platform.

Nothing in these terms limits our liability for death or personal injury caused directly by our proven willful intent or gross negligence.

7. Account Termination

• By You: You may terminate your account at any time. To do so, use the self-service Delete Account feature inside the app settings, or contact us at info@lazoneclimbing.com (see our Privacy Policy for details on data handling upon deletion).
• By Us: We reserve the right to terminate or suspend your account and block your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

8. Governing Law & Jurisdiction

These Terms, and any dispute arising out of or in connection with them, shall be governed by and construed in accordance with the laws of Germany, excluding its conflict of law principles.

Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Stuttgart/Reutlingen, Germany, and you hereby consent to the personal jurisdiction and venue of such courts.

9. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 15 days' notice within the App or via email before any new terms take effect.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the Platform.
